Saudi Arabia launched a national AI strategy as part of Vision 2030, and SDAIA has issued AI ethics principles. However, a direct legal liability framework for AI system harm is not yet completed by dedicated legislation — authorities apply general principles of tort and contractual liability.
SDAIA's AI ethics principles include: transparency in algorithmic decision-making, fairness and bias mitigation, accountability, and respect for privacy. Organizations deploying AI systems are advised to adopt governance policies aligned with these principles.
Algorithmic accountability means the ability to explain system outputs and trace its decisions. Black-box systems — where the reason for a specific decision cannot be explained — increase risk in disputes. Documenting training methodology, data used, and decision criteria builds a defensive record.
Liability for AI decisions is still determined case by case — transparency, documentation, and periodic review reduce legal and reputational risk.
Bias risks: training on unrepresentative or skewed data produces algorithmic bias. Discrimination in hiring, lending, or services based on AI outputs may expose to liability. Best practices require periodic audit of system outputs and measurement of disparity across groups.
Data protection in training: data used to train models — whether personal or not — is subject to PDPL when it constitutes personal data. Consent, legitimate interest, or another legal basis is required. Using customer or employee data without a clear legal basis creates regulatory risk.
Procurement considerations: organizations purchasing AI solutions need contractual terms covering: liability for harm, intellectual property in outputs, bias warranties, and vendor commitment to assist with PDPL compliance. Unlimited liability disclaimers in software contracts do not eliminate tort liability in cases of negligence.
Criminal and civil liability for AI actions is not yet explicitly regulated by statute in the Kingdom. Courts may apply agency or supervision principles — the natural or legal person controlling the system may be held liable. Documenting human oversight and control strengthens the defensive position.

The party operating the system bears liability for its use.
Verdict:
Global trend favors shared liability or allocation by control and intervention level. In Saudi Arabia, a clear framework is under development — follow SDAIA.
